These Terms of Service ("Terms") govern your access to and use of Football Pitch Simulator ("the Game"), developed and published by Incipient Day ("we", "us", or "our").

By purchasing, downloading, installing, accessing, or playing Football Pitch Simulator, you agree to these Terms. If you do not agree to these Terms, you should not use the Game.

1. About the Game

Football Pitch Simulator is a video game developed and published by Incipient Day and distributed through third-party platforms such as Steam.

The Game may include single-player, online multiplayer, voice communication, Steam Cloud, achievements, and other online or platform-based functionality.

2. Eligibility and Acceptance

By accessing or using the Game, you confirm that you are legally permitted to use the Game under the laws applicable to you and that you agree to comply with these Terms.

If you are not legally able to agree to these Terms, you may only use the Game with the involvement and permission of a parent or legal guardian where permitted by applicable law.

3. Game License

Subject to these Terms and applicable platform rules, Incipient Day grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use Football Pitch Simulator for personal entertainment purposes.

Purchasing the Game does not give you ownership of the Game, its source code, assets, intellectual property, or related services.

4. Steam and Third-Party Platforms

Football Pitch Simulator is distributed through Steam and may rely on services provided by Valve Corporation.

Your use of Steam and Steam-related functionality is also subject to Valve Corporation's applicable agreements, policies, and terms.

Steam may provide services including authentication, multiplayer connectivity, achievements, Steam Cloud, game distribution, payments, and other platform functionality.

Incipient Day is not responsible for interruptions, restrictions, changes, or failures affecting third-party services that are outside our reasonable control.

5. Online and Multiplayer Services

The Game may provide online multiplayer functionality that allows players to interact and play with other users.

Online functionality may require an internet connection and access to Steam or other applicable platform services.

We do not guarantee that multiplayer or other online services will always be available, uninterrupted, secure, or error-free.

6. Player Conduct

When using Football Pitch Simulator, particularly its multiplayer and communication features, you agree to behave in a manner that does not intentionally interfere with the Game or other players.

You may not:

Use the Game for unlawful purposes
Use cheats, exploits, unauthorized software, scripts, or other tools intended to gain an unfair advantage
Attempt to interfere with, damage, overload, or disrupt multiplayer functionality or related services
Attempt to gain unauthorized access to systems, services, accounts, or information
Distribute malware, malicious code, or other harmful material through the Game
Intentionally exploit bugs or vulnerabilities in a manner that negatively affects the Game or other players
Harass, threaten, impersonate, or intentionally abuse other players through communication features

7. Voice and Player Communication

The Game may include voice communication or other features that allow players to communicate with each other.

You are responsible for what you choose to communicate or disclose to other players.

Communications made by individual players do not represent the views of Incipient Day.

Incipient Day is not responsible for player-generated communications or interactions except to the extent that responsibility cannot be excluded under applicable law.

8. Game Updates and Modifications

Football Pitch Simulator may receive updates, patches, bug fixes, balancing changes, new content, feature changes, or other modifications.

We reserve the right to modify, add, replace, rebalance, or remove Game features or content where reasonably necessary for the development, maintenance, security, or operation of the Game.

Updates may also be required to continue accessing certain features of the Game.

9. Service Availability

We aim to keep Football Pitch Simulator and its supported services operational, but continuous availability cannot be guaranteed.

The Game or certain features may temporarily or permanently become unavailable because of maintenance, technical problems, updates, security concerns, third-party platform changes, legal requirements, or circumstances outside our reasonable control.

10. Purchases, Payments, and Refunds

Purchases made through Steam or another third-party platform are processed by the applicable platform provider.

Payment information provided directly to Steam is processed by Valve Corporation and is not independently processed by Incipient Day as part of the Game.

Refunds for purchases made through Steam are generally governed by Steam's applicable refund policies and consumer protection laws.

11. Intellectual Property

Football Pitch Simulator, Incipient Day, and the content associated with the Game, including software, source code, artwork, graphics, characters, 3D models, animations, audio, music, interfaces, logos, designs, text, and other materials, are owned by or licensed to Incipient Day unless otherwise stated.

These materials are protected by copyright, trademark, and other applicable intellectual property laws.

Except where permitted by applicable law or expressly authorized by Incipient Day, you may not reproduce, distribute, sell, license, commercially exploit, or otherwise use protected Game content independently from the Game.

12. Gameplay Videos and Content Creation

Players are permitted to create and publish gameplay videos, screenshots, livestreams, reviews, commentary, and similar content featuring Football Pitch Simulator.

Such content may generally be monetized through legitimate content platforms, provided that it does not falsely claim to be official Incipient Day content or imply an endorsement, sponsorship, or partnership that does not exist.

13. Suspension and Termination

Where technically available and permitted by applicable law and platform rules, Incipient Day may restrict access to certain online functionality when reasonably necessary to protect the Game, its services, or other players.

This may include cases involving serious or repeated violations of these Terms, cheating, malicious activity, security threats, unlawful conduct, or intentional disruption of online services.

You may stop using the Game at any time.

14. Save Data and User Settings

Football Pitch Simulator may store save data, settings, preferences, and other information required to provide Game functionality.

Some information may be stored locally on your device, while supported data may also be synchronized through services such as Steam Cloud.

Although reasonable efforts are made to maintain the stability of save systems, we cannot guarantee that save data will never be lost, corrupted, overwritten, or otherwise affected by technical issues, hardware failures, platform problems, modifications, user actions, or other circumstances outside our reasonable control.

15. Privacy

Your privacy is important to us. Information processed in connection with Football Pitch Simulator is handled as described in our Privacy Policy.

Our Privacy Policy explains what information may be processed, why it may be processed, and how third-party services such as Steam may be involved.

16. Disclaimer

To the maximum extent permitted by applicable law, Football Pitch Simulator and its related services are provided on an "as is" and "as available" basis.

We do not guarantee that the Game will always operate without interruptions, bugs, errors, compatibility issues, or other technical problems.

Nothing in these Terms affects statutory warranties or consumer rights that cannot legally be excluded or limited.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Incipient Day will not be liable for indirect, incidental, special, consequential, or similar damages resulting from your use of or inability to use the Game or related online services.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

18. Changes to the Service

We may change, update, suspend, discontinue, or replace parts of Football Pitch Simulator or its related services where reasonably necessary.

This may occur because of development decisions, technical requirements, security considerations, platform changes, legal requirements, or other operational reasons.

19. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to the Game, our services, platform requirements, business practices, or applicable laws.

When these Terms are updated, the "Last Updated" date at the top of this page will be revised.

Your continued use of the Game following changes to these Terms will be subject to the updated Terms to the extent permitted by applicable law.

20. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by applicable law.
